In this appeal, we address the question of whether a trial court can enter a divorce decree that encompasses a property settlement contrary to the agreement of the parties without a hearing duly noticed. We conclude that the decree is void insofar as it changed the agreement of the parties. Consequently, we reverse the order of the district court even though it declined to find the appellant in contempt of court because the same order required him...
