Defendant was arrested and charged with sodomy on a child in violation of Utah Code Ann. § 76-5-403.1 (1978, Supp. 1989) (amended 1988), stemming from an incident where he allegedly engaged in oral sex with a 13-year-old boy. At trial, the victim, in detailing the incident, described additional sexual acts involving his 15-year-old brother and defendant. Defendant was separately charged and tried for the offense against the brother...
