Plaintiff, Kenneth John Gibbs, brought this Federal Employer's Liability Act (FELA) claim against defendant, Illinois Central Gulf Railroad Company (Illinois Central) based upon job-related injuries. Gibbs' earlier filing of an action in Missouri state court on the same cause of action was dismissed on the basis of forum non conveniens.
