WEAVER, J.

Following a jury trial, defendant was convicted of operating a motor vehicle while under the influence of intoxicating liquor (OUIL), second offense, MCL 257.625(5); MSA 9.2325(5). He was sentenced to eight days in the county jail plus payment of costs, treatment for alcohol abuse, and eighteen months probation. Defendant's conviction was affirmed by the circuit court. After an initial denial of leave to appeal, we consider the matter
