This case comes to us by a petition of the state to review a decision of the court of appeals1 which reversed a judgment convicting Harold Koput (Koput) of first degree murder. The appeal was from the judgment of the circuit court for Milwaukee county, Ralph G. Gorenstein, Circuit Judge.
