On December 27, 1985, the single commissioner issued an opinion and order which denied the applicants' claim for an award of reparations based upon the finding that the decedent, Robert A. Thompson, engaged in contributory misconduct.

On January 28, 1986, the applicants, Delmar O., Teresa Z., and Mary L. Thompson, filed an objection and notice of appeal from the December 27, 1985 determination.
