Following conviction in 1981 for burglary in the first degree, attempted aggravated assault upon a peace officer and criminal use of a firearm in the first degree, defendant was accused of being a predicate felon in that he had previously been convicted of attempted burglary in the second degree in 1980. At the predicate felony hearing, County Court advised him of his right to deny the allegation and to challenge the constitutionality...
