This appeal presents several issues, the first issue being whether or not the trial court committed error in granting defendants' motion for partial summary judgment, dismissing plaintiffs' contention that there exists an "imprescriptible mineral servitude" in their favor. The second issue presented is whether or not plaintiffs' appeal of the trial court's rulings denying plaintiffs' cross-motion for summary judgment and peremptory exceptions of res judicata...
