Plain were charged in a three-count indictment with (1) conspiracy to possess with intent to distribute more than 500 grams of cocaine, (2) possession with intent to distribute more than 500 grams of cocaine, and (3) distribution of over 500 grams of cocaine, pursuant to 21 U.S.C. §§ 846 and 841(a)(1).
