Defendant-appellant James L. Love was charged in a three-count indictment with rape of a person under the age of thirteen by force or threat of force, gross sexual imposition and attempted rape. The charges were tried to a jury. At the close of the state's case, the trial court granted defendant's Crim. R. 29 motion for acquittal on the charge of gross sexual imposition.
