Appellant, Moses Everett, was charged by a bill of information with attempted second degree murder, a violation of La.R. S. 14:30.1 and La.R.S. 14:27. After a trial on the merits, appellant was found guilty by a twelve person jury of the lesser included offense of aggravated battery, a violation of La.R.S. 14:34. On October 19, 1987, appellant was sentenced to six years at hard labor. Everett's sentence was to run concurrently with any other sentence...
