163 Mich. App. 697 (1987)

415 N.W.2d 279

DAUGHERTY v. STATE OF MICHIGAN

Michigan Court of Appeals.

Decided October 19, 1987.

Attorney(s) appearing for the Case

Kenneth A. Webb, for plaintiff.

Frank J. Kelley, Attorney General, Louis J. Caruso, Solicitor General, and Theodore E. Hughes, Assistant Attorney General, for defendant.

Before: HOOD, P.J., and MacKENZIE and R.M. PAJTAS, JJ.

AFTER SECOND REMAND

R.M. PAJTAS, J.

Plaintiff, personal representative of the estate of Vincent Daugherty, deceased, and brother of the decedent, appeals as of right from an order of the Court of Claims which dismissed plaintiff's action for failure to comply with an order of discovery. On appeal, plaintiff argues that the trial judge abused his discretion in granting defendant's motion to dismiss. We disagree and affirm.
