WATSON, Justice.

Sherif Y. Boulos and Paul J. Durso seek the sum of $8,250 from Morris Lew1 d/b/a Casa Alejandro, alleging the cash was given to Lew's agent, Miguel "Mike" Felberg or Feldberg, for merchandise which was never delivered. The trial judge dismissed the suit, and the court of appeal affirmed.2 A writ was granted to review that judgment.
