On October 21, 1986, appellant Terence Larkin, a police officer, was served with a recommendation for discharge from his position, effective August 26, 1986. The matter was heard initially by an administrative law judge who found that appellant resigned on August 19, 1986, and found that the city failed to prove Larkin was insubordinate or engaged in conduct sufficient to warrant a discharge.
