The defendants were indicted for conspiring to possess cocaine and heroin with the intent to distribute, and for conspiring to distribute cocaine and heroin. After a jury trial, the defendants were found guilty. The defendants raise a number of objections to their convictions. We conclude that, because the jury was inadequately instructed on the defendants' theory of defense, their Fifth Amendment rights were violated. We therefore vacate the...
