COATS, Judge.

Mark Smith was convicted, based upon his plea of nolo contendere, of criminally negligent homicide, AS 11.41.130, a class C felony, and failure to render assistance after an injury accident, AS 28.35.060(a), an unclassified felony with a maximum sentence of ten years. Superior Court Judge Gerald J. Van Hoomissen sentenced Smith, a first-felony offender, to five years on the homicide charge and to ten years with five years suspended...
