The United States appeals the district court's dismissal with prejudice of an indictment against Alvin August Kramer. The district court found that Kramer's right to a speedy trial pursuant to the Speedy Trial Act, 18 U.S.C. §§ 3161-3174 had been violated. On appeal to this court, the United States argues that the district court abused its discretion by dismissing the indictment with prejudice, rather than dismissing the indictment...
