Presently before the Court is defendants' motion to dismiss plaintiff's pro se complaint which seeks injunctive relief and monetary damages for alleged violations of the civil rights of the plaintiff, Mrs. Ernestine A. Fultz. Because matters outside the pleadings have been presented to the Court and considered by it, we will construe defendants' motion to dismiss as one for summary judgment.
