We asked the parties to brief the question whether, in view of the following chronology, we have jurisdiction of this appeal. On May 14 of this year the district court denied a motion under Rule 35 of the Federal Rules of Criminal Procedure for reduction of sentence, and a motion under 28 U.S.C. § 2255 to vacate sentence, both filed by Gargano, a federal prisoner.
