Pocahontas Supreme Coal Co. and its sole stockholder, Edward Borg (collectively "Pocahontas"), sued the defendants, various coal mining companies, alleging a number of federal and state antitrust violations and a civil RICO violation. The district court dismissed some of the claims as time barred, and the others for failure to state claims under Fed.R.Civ.P. 12(b)(6). The court also declined to award attorney's fees to defendants...
