COOPER, Judge.
The sole issue in this criminal appeal is whether the trial judge erred in submitting to the jury lesser included offense instructions when the grand jury indictments had not been amended and the State's case had not addressed the question of lesser offenses. We find no error, and therefore, we affirm the judgment of the trial court.
