The appellant, Douglas C. Klingelhoefer, was charged in the county court for Buffalo County, Nebraska, with driving while intoxicated, in violation of Neb.Rev.Stat. § 39-669.07 (Reissue 1984), and with refusing to submit to a chemical test of his breath, in violation of Neb.Rev.Stat. § 39-669.08 (Reissue 1984).
