POPOVICH, Chief Judge.

Appellant's driving privileges were revoked under the implied consent statute, and he petitioned for judicial review. The trial court rescinded the revocation. The Commissioner of Public Safety then moved for relief under Minn.R.Civ.P. 60.02, because the appellate case the trial court relied on had since been reversed.
