After his home was damaged by fire, plaintiff, W.P. Sevier,1 instituted this action to recover certain proceeds from a homeowner's policy containing the statutorily provided fire requirements. During the course of this litigation, defendant filed certain exceptions, including an exception of prematurity, alleging that plaintiff had not complied with the requirements of the insurance policy prior to institution of this suit...
