MEMORANDUM AND ORDER

LOVELL, District Judge.

Defendant Ervin J. Hanks was tried before a jury and convicted of seven counts of willful failure to file federal income tax returns. 26 U.S.C. § 7203. The jury returned its verdict on February 12, 1986.

This case comes before the Court on defendant's motion for a new trial. Rule 33, Fed.R.Crim.P. The motion was filed on April 16, 1986 and the issues have been briefed. Defendant advances four grounds...
