THE FACTS

This case arises out of a workers' compensation claim by Frank Harper against K & W Trucking. Harper agreed to settle the claim for a lump sum payment of $45,000. The Alaska Workers' Compensation Board approved the settlement agreement on February 10, 1984. Harper contends that K & W and its insurance carrier, Transit Casualty (hereinafter defendants), must pay him a penalty because they did not honor...
