Plaintiffs, Mr. and Mrs. Robert Miller and Dr. and Mrs. Liang Oey, (hereinafter referred to as plaintiffs), seek damages for breach of contract and warranty of fitness of two lots purchased from defendant, Frank Ebarb, Inc., (hereinafter referred to as defendant). The sole shareholder and president of the corporation is Mr. Frank Ebarb. Plaintiffs alleged sewage has backed up into their respective homes and lawns on several occasions...
