Defendant, Ralph C. Jackson, was indicted for the crime of possession of heroin with the intent to distribute. R.S. 40:966. He was found guilty by a twelve member jury of possession of heroin. R.S. 40:966(C)(1). The court sentenced the defendant to serve nine years at hard labor in the custody of the Department of Corrections, with four years of the sentence to be served without the benefit of parole, probation or suspension of sentence.
