In this tort action by a former inmate for damages suffered while incarcerated in the House of Detention in New Orleans, plaintiffs appeal from the pretrial dismissal of their petition against the City of New Orleans. The basis of the City's motion to dismiss was that it had no responsibility for supervision or operation of the prison and could not be held liable for the alleged negligence of the deputy criminal sheriffs who staffed the facility.
