This is a declaratory judgment action. The First National Bank of Russellville sued R & A Construction Products, Inc., Owens Fabricating Company, Inc., and Robert E. Owens for a determination of the amount due under a contract. Owens Fabricating had assigned to the bank its rights under a contract with R & A Construction.
