Appellant Mudgett brought suit against Thopax Investment Corporation (the former Paxson Machine Company) (Paxson I) and Paxson Machine Company (Paxson II) as a result of personal injuries he sustained in an accident involving a metal-slitting machine.1 Prior to the accident, Paxson I sold its assets to Paxson II, and then changed its name to Thopax Investment Corporation.
