STATEMENT OF THE CASE

Defendant-appellant, City of Tell City, Indiana (Tell City), suffered an adverse judgment in the amount of $300,000.00 entered pursuant to a jury verdict in the Spencer Circuit Court in favor of John Brian Noble (Noble). From that judgment Tell City appeals.
