In a trial to the court, Donald K. Turner was convicted on three counts of tax fraud. The first two counts charged Turner with willfully evading federal income tax for the years 1978 and 1979 in violation of 26 U.S.C. § 7201. The third count charged Turner with willfully making a false statement on his federal income tax return for the year 1980 in violation of 18 U.S.C. § 1001.
