Marshall Stewart was an industrial relations representative at RCA's plant in Marion, Indiana, until he was laid off on November 30, 1982. He filed this suit on October 16, 1984, maintaining that RCA discriminated against him on account of race, in violation of 42 U.S.C. § 1981.
