This patent case is before the Court on defendant's motion in limine, which seeks to limit the evidence to be introduced in this action to those issues that were raised before the Patent and Trademark Office. Specifically, the motion seeks exclusion of all evidence relating to "commercial success" and "copying" by others, because, defendants contend, plaintiffs failed to raise these issues...
