Defendant, Harold Mayeux, was indicted on two counts of aggravated battery in violation of La.R.S. 14:34. The jury was instructed, at the request of defense counsel, that in response to the crime charged a verdict of guilty of attempted aggravated battery could be returned. The State failed to object to the improper charge during trial. After nearly six and a half hours of deliberations...
