The defendant, originally charged with attempted second degree murder, was convicted after a jury trial of the offense of aggravated battery. The trial judge invoked LSA-C.Cr.P. Art. 893.1 and sentenced the defendant to five years at hard labor without benefit of parole, probation or suspension of sentence.
