The instant appeal stems from a tort action in which it was claimed that the defendant/appellant (Winn-Dixie) was negligent in the maintenance of its premises at the moment the plaintiff/appellee (Vote) slipped and fell, allegedly as a result of a discarded cigarette butt being permitted to remain on the floor.
