This personal injury suit arose from an accident in which a van apparently struck a cow on an "open-range" highway. Cora Roberts (plaintiff), a passenger in a vehicle owned and driven by George Godso, was injured. She brought suit against Godso's insurer, Colonial Penn Insurance Company1 and the Louisiana Department of Transportation and Development (DOTD).
