In December 1978 the appellant, Leonard J. Rose, brought suit in Massachusetts Superior Court, alleging that the town of Harwich, Massachusetts, had unlawfully taken a piece of his land. He lost the suit, basically because the relevant statute of limitations had run. He then filed this suit in federal court for the District of Massachusetts, essentially claiming that the town had taken his property without satisfying the procedures or paying...
