At about 7:30 on an icy morning in January of 1982, Elke Gilbert's automobile was struck in the rear by a vehicle driven by an employee of Diversified Graphics. Gilbert claimed personal injuries and property damage and sued Diversified Graphics for $300,000. She alleged that she had $12,895.81 in actual damages.
