MINZNER, Judge.

Defendant appeals his convictions of aggravated battery and assault on a peace officer, each with a firearm, claiming that joinder was improper under NMSA 1978, Crim.P. Rule 10 (Repl.Pamp. 1980) and that the lower court erred in denying his motion for severance under NMSA 1978, Crim.P. Rule 34 (Repl.Pamp.1980).
