This is an appeal from a judgment of $25,500.00 in favor of the appellee in an action for malicious prosecution.

Sometime between 9:30 P.M. December 28, 1980, and 8:00 A.M. on December 29, 1980, a gate, lock and fence around a portion of the appellant's farm were damaged.
