November 12, 1985.

Attorney(s) appearing for the Case

John L. Kopolow, Asst. Public Defender, Baltimore (Alan H. Murrell, Public Defender, George E. Burns, Jr., Michael R. Braudes, Asst. Public Defenders, Baltimore, on the brief), for appellant.

Argued before MURPHY, C.J., SMITH, ELDRIDGE, COLE, RODOWSKY and COUCH, JJ., and JAMES C. MORTON, Jr., Associate Judge of the Court of Special Appeals (retired), Specially Assigned.

ELDRIDGE, Judge.

In February 1982, the defendant-appellant, Doris Ann Foster, was found guilty of felony murder by a jury in the Circuit Court for Cecil County. The defendant elected to be sentenced by the court, and, following a hearing, a sentence of death was imposed. On appeal, this Court held that certain evidence was erroneously excluded at trial, and we reversed the judgment and remanded for a new trial. Foster v. State, 297 Md. 191
