OPINION

EMIL F. GOLDHABER, Chief Judge:

The issue in this case is whether an agreement signed by the debtor and the defendant constitutes a valid contract on which the trustee can successfully bring an action for breach. For the reasons stated herein, we conclude that the document at issue is a valid contract which the defendant breached.
