We granted the petition to review Snowden v. State, 449 So.2d 332 (Fla. 5th DCA 1984), because of conflict with Hawkins v. State, 436 So.2d 44 (Fla. 1983). We have jurisdiction. Art. V, § 3(b)(3), Fla. Const.
