The limited issue on this appeal is whether Special Term, by its order entered June 5, 1984, properly modified the order of Justice Nathaniel Helman, entered March 9, 1978, certifying this action as a class action (affirmed by this court on Justice Helman's opinion, 66 A.D.2d 669, appeal dismissed 47 N.Y.2d 882).
