OPINION

EUBANK, Presiding Judge.

Appellant Gerard B. Loughran was arrested in the city of Phoenix on July 15, 1982, for solicitation of prostitution. Appellant was charged with a violation of Phoenix City Code § 23-52. Phoenix City Code § 23-52(a) reads:

(a) A person is guilty of a misdemeanor who: (1) offers to, agrees to, or commits an act of prostitution; (2) solicits or hires another person...
