Jan J. Porretto was indicted by the grand jury with the first degree murder of Arthur W. Bohmfalk. At trial, the jury was unable to agree upon a verdict and a mistrial was declared. Thereafter, the indictment was amended to charge defendant with second degree murder. Defendant was also charged by bill of information with attempted second degree murder of Joan Bohmfalk.
