Defendant, Gary L. Crete, was charged by information on November 8, 1982, with the offenses of aggravated battery, resisting a police officer and criminal damage to property. (Ill. Rev. Stat. 1981, ch. 38, pars. 12-4(b)(6), 31-1, 21-1(a).) The first trial by jury on May 31, 1983, resulted in a mistrial.
